Description

Employing non-European Economic Area (EEA) nationals is an area of Immigration Law that is evolving and since February 2008 the Home Office and the Border and Immigration Agency (“BIA”) have become more vigilant against illegal employment. Even the UK Attorney General, Baroness Scotland, famously fell foul of the law and was fined £5,000 in September.

The definition of illegal employment extends beyond the employment of a person who does not have the right to be in the UK. It is not just the small companies that the Home Office and the BIA are targeting. Recruitment companies, engineering firms and restaurants have been fined.
